TERMS AND CONDITIONS
These terms and conditions apply to all purchases made via the Grace Manchester website. By placing an order, you agree to these terms and conditions in full. Grace Manchester reserves the right to update these terms at any time. The most recent version will always be available on our website.
Article 1 – Applicability
1.1 These terms and conditions apply to all offers, orders, and agreements between Grace Manchester and the customer.
1.2 By placing an order, the customer explicitly accepts these terms and waives any right to apply their own terms and conditions.
1.3 If any provision of these terms is found to be null and void or otherwise unenforceable, the remaining provisions shall remain in full force and effect.
1.4 We reserve the right to amend these terms at any time. Changes will not apply retroactively.
Article 2 – Product Information
2.1 We make every effort to describe products accurately and provide up-to-date information. Product images are for illustrative purposes only and may differ slightly from the actual product.
2.2 Typographical errors, technical inaccuracies, or price changes are reserved. We are entitled to cancel an order in the event of an obvious error in the price or product description.
2.3 Product availability cannot be guaranteed. If a product is no longer available, you will be informed as soon as possible and fully refunded.
Article 3 – Ordering and Payment
3.1 An agreement is concluded at the moment we confirm your order in writing (by email).
3.2 Orders are processed after receipt of full payment. Until payment is received, we reserve the right to suspend the order.
3.3 Available payment methods may vary by country and over time. It is your responsibility to verify which payment methods are available for your location.
3.4 All prices are inclusive of VAT (where applicable) unless explicitly stated otherwise. Any import duties or customs charges are the responsibility of the customer.
Article 4 – Processing and Delivery
4.1 Processing time: 1 to 3 business days after receipt of payment.
4.2 Shipping time: 3 to 7 business days, depending on your location. Shipments are dispatched directly from our supplier in China. Delays due to customs or external circumstances are beyond our control.
4.3 You will receive a confirmation email including a Track & Trace code once your order has been dispatched. It is your responsibility to monitor the delivery process.
4.4 We are not liable for delays caused by third parties, including but not limited to carriers, customs authorities, or force majeure events.
Article 5 – Returns and Cancellations
5.1 You have the right to cancel an order as long as it has not yet been dispatched. Once shipped, the returns policy applies.
5.2 Returns are only accepted if the product is undamaged, unused, and returned in its original packaging within 14 days of receipt.
5.3 Return shipping costs are your responsibility, unless the product is defective or incorrectly delivered. In such cases, we will cover the return shipping costs.
5.4 Upon receipt and inspection of the returned item, the purchase amount will be refunded within 14 business days to your original payment method.
Article 6 – Liability
6.1 We are not liable for loss or damage during transit if the Track & Trace system confirms that the package has been delivered to the address provided.
6.2 You are responsible for providing a correct and complete delivery address. We cannot be held liable for non-delivery resulting from an incorrect address.
6.3 In all cases, our total liability is limited to the amount you paid for the relevant order.
Article 7 – Intellectual Property
7.1 All content on the Grace Manchester website, including texts, images, logos, videos, and graphic materials, is our property or that of our licensors.
7.2 It is not permitted to copy, distribute, publish, or otherwise use any content from the website without our explicit written consent.
Article 8 – Privacy and Data Protection
8.1 We process personal data in accordance with the General Data Protection Regulation (GDPR).
8.2 Personal data is used solely for the purpose of processing orders, providing customer service, and complying with legal obligations.
8.3 We do not share personal data with third parties unless necessary for the execution of the agreement (e.g. carriers) or required by law.
Article 9 – Complaints Procedure
9.1 Complaints regarding products or services can be submitted in writing to info@gracemanchester.co.uk. Please include your order number and a clear description of the complaint.
9.2 We aim to respond to all complaints within 5 business days. For complex complaints, you will receive an acknowledgement of receipt with an estimated resolution timeline.
9.3 If a complaint is not resolved to your satisfaction, you have the right to submit the dispute to the competent court or a recognised disputes committee.
Article 10 – Governing Law and Jurisdiction
10.1 All agreements are exclusively governed by Dutch law.
10.2 Any disputes arising from or related to an agreement shall be submitted to the competent court in the district where we are established.
10.3 Consumers have the right, within 30 days of a dispute arising, to choose the legally competent court in their own jurisdiction.
